1. Application of These Terms and Conditions
These Terms and Conditions govern the relationship between the Client and Africa Odyssey Safaris
and Tours and apply in the following situations:
When you book a tour with us
When you confirm a booking with us
By booking a tour with us, you acknowledge that you have read, understood, and agreed to be
bound by these Terms and Conditions.
These Terms and Conditions define the rights and responsibilities of both the Client and the
Company in relation to all tours and travel services provided by Africa Odyssey Safari and our Travel
Partners
2. Our Warranties and Representations
Africa Odyssey Safaris and Tours confirms that:
Our Travel and Tours Partners, Agents, guides and drivers have extensive experience and are
professionally trained and experienced in their respective fields.
All information used in our marketing and promotional materials is accurate to the best of our
kmowledge. We do not intentionally misrepresent our services.
We operate as a travel consultancy and do not directly manage our tours.
Third-party services are limited to accommodation providers, airlines, and other external suppliers
where applicable.
Our Partners are committed to responsible tourism, environmental conservation, and supporting
local communities through sustainable tourism practices and fair employment.
3. Treatment of Personal Information
To organize your tour arrangements, we may require personal information, including your full name,
nationality, Passport details, Age, Dietary requirements, and Relevant medical information.
This information may be shared only with national park authorities, accommodation providers,
airlines, or other relevant service providers, as necessary, for operational purposes related to your
tour.
We are committed to handling your personal information responsibly and confidentially.
4. Booking and Payment Process
The booking process begins once you contact us by email, phone, WhatsApp, or through our website.
Our admin team will assist you with planning and organizing your tour.
Once the itinerary and arrangements are confirmed, an invoice will be issued for payment.
Booking Confirmation
Your booking will be confirmed once the required deposit payment has been received in our account.
Final Payment
Unless otherwise agreed in writing, full payment for all tours must be completed no later than 30
days before the tour start date.Failure to make payments on time may result in cancellation of the
booking, and cancellation charges may apply.
Transaction Charges
All bank transfer fees must be covered by the Client.Credit card payments may be subject to a 3.5%
surcharge.
5. Participation of Minors
Minors must always be accompanied and supervised by an adult during the tour.
The accompanying adult is fully responsible for the minor’s conduct, travel documents, permits,and
legal travel requirements.
6.Prices
Once your booking is confirmed, tour prices shall remain unchanged except in cases where
government taxes, park fees, concession fees, or other tourism-related charges are increased by local
authorities.
In such cases, clients will have the option to:
Accept the revised price and pay the difference; or
Cancel the tour according to the applicable cancellation policy
7.Changes to the Itinerary
Changes Requested by the Client
Clients may request itinerary changes. If the changes result in additional costs, such costs shall be
paid by the Client.
No refunds will be issued for:
Missed services,
Unused accommodations,
Missed meals,
Voluntary withdrawal from the tour.
Changes by the Company
We reserve the right to make reasonable itinerary adjustments due to weather conditions, road
accessibility, safety concerns, operational requirements, or circumstances beyond our control.
Whenever possible, clients will be informed promptly.
8.Changes to Travel Dates
Requests to change travel dates must be submitted at least 60 days before the original departure
date.
New travel dates must fall within one year of the original booking date.
Changes are subject to availability and supplier policies.
Additional costs resulting from airline penalties, seasonal accommodation rates, or supplier charges
must be covered by the Client.
9.Cancellation Policy
Cancellation by the Client
Cancellation of booking or failure to join a tour will result in retention of funds as described below.
Upon receipt of written cancellation by any member of the tour indicated on this reservation 30 days
or longer before departure, 25% of the reservation of the cancelling party will be retained by Africa
Odyssey Safaris and Tours and the balance of the package price will be refunded.
If a cancellation is received at least 14 days and up to 29 days before departure, 50% of the package
price will be retained
If a cancellation is received less than 14 days before departure, 100% of the total package price will
be retained and all outstanding payments will become payable immediately.
Africa Odyssey Safaris and Tours and its Agents, reserve the right to terminate, at their discretion
and with immediate effect, the participation of any person on the tour.
Please note that some hotels, lodges, airlines, and third-party suppliers may impose higher
cancellation penalties. Any additional non-refundable charges and bank transaction fees shall be
deducted from the refund amount.
Refund Processing Fee:
While processing a refund, a 3% credit card fee is charged to the client’s Visa, AMEX, or MasterCard.
When a refund is processed using a Bank Transfer payment, bank charges apply.
Cancellation by the Company
In the unlikely event that Africa Odyssey Safaris and Tours cancels a tour for reasons within our
control, clients will receive a full refund of all payments made to us.
10. Accommodation
Hotel Accommodation
Accommodation arrangements depend on the selected travel package and room occupancy
preferences.
Single supplements may apply for clients requesting private rooms.
If a listed hotel becomes unavailable, we reserve the right to provide a similar alternative
accommodation of equivalent standard.
11. Travel Insurance
Travel insurance is mandatory for all clients participating in our tours.
Your insurance policy should include coverage for:
Medical emergencies,
Emergency evacuation,
Trip cancellation,
Travel delays,
Personal injury,
Repatriation.
For Kilimanjaro climbs, insurance must specifically cover high-altitude trekking up to 6,000 meters
and helicopter evacuation.
Failure to provide adequate insurance may result in refusal to participate in the tour without refund.
12. Vaccinations and Medical Advice
We provide only general travel health information.
Clients are responsible for consulting a licensed medical professional regarding recommended
vaccinations, medications, and health precautions before traveling to Africa
13. Equipment and Gear for Kilimanjaro Climbs
Personal climbing gear is not included unless specifically stated in the package.
Clients are responsible for bringing suitable personal equipment. Equipment rental services may be
available at an additional cost.
Our Tour Operators reserve the right to inspect climbing equipment before the expedition begins to
ensure safety standards are met.
14. Luggage and Valuables
We are not responsible for luggage lost, delayed, or damaged by airlines or third-party transportation
providers.
Clients are responsible for safeguarding their personal belongings, including valuables, money,
electronics, and travel documents.
Where requested, valuables may be stored securely in a company safe at the Client’s own risk and
subject to agreement.
15. Force Majeure
Africa Odyssey Safaris and Tours and our Travel Partners shall not be held liable for delays,
cancellations, losses, injuries, or failure to perform obligations resulting from circumstances beyond
our reasonable control, including but not limited to:
Natural disasters,
Extreme weather,
Government actions,
Political unrest,
Wars,
Strikes,
Pandemics,
Mechanical breakdowns,
Transportation disruptions,
Civil disturbances.
